DMCA Policy

Heftceramics (“the Company”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the text of which may be found on the U.S. Copyright Office website at copyright.gov), we will respond expeditiously to claims of copyright infringement committed using the Heftceramics website (the “Site”) if such claims are reported to our Designated Copyright Agent identified below.

1. Notice of Intellectual Property Infringement

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing a DMCA Notice of Alleged Infringement and delivering it to our Designated Agent.

To be effective, the Notification must include the following information:

  • Identification of the Work: Identify the copyrighted work that you claim has been infringed (e.g., a specific design from our Artisan Vases or Luxe Essentials catalog).
  • Identification of the Material: Identify the material or link you claim is infringing and to which access is to be disabled, including at a minimum the URL of the link shown on the Site or the exact location where such material may be found.
  • Contact Information: Provide your company affiliation (if applicable), mailing address, telephone number, and email address.
  • Good Faith Statement: Include a statement that you have a "good faith belief that use of the copyrighted material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  • Accuracy & Perjury Statement: Include a statement that "the information in this notice is accurate, and under penalty of perjury, that you are the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."
  • Signature: Provide your full legal name and your electronic or physical signature.

2. Counter-Notification Procedures

If you receive a notification that a product listing or content has been removed due to a copyright infringement claim, and you believe that the removal was a result of mistake or misidentification, you may file a Counter-Notice.

Your Counter-Notice must be a written communication that includes:

  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the State of Florida) and that you will accept service of process from the person who provided the original infringement notification.
  • Your physical or electronic signature.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Heftceramics has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or supply chain partners who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

4. Liability for Misrepresentation (Section 512(f))

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorney's fees incurred by Heftceramics or its customers.
